Terms of sale

Plain terms for a single garment. If anything here is unclear, ask before you order — we would rather answer the question than argue about it later.

1. Who you are buying from

Vitruvian Tailor is a business of TRUE SMILE PTY LTD, ABN 19 684 161 966. Garments are sourced as ready-to-wear and tailored in Perth, Western Australia. In these terms, "we" and "us" mean that company; "you" means the person placing the order.

2. What you are buying

The Founding Fit is a ready-to-wear dress shirt that we source and then alter by hand in Perth to match your measurement profile. It is finished by a tailor working from your eight-point profile.

It is not factory made-to-measure. We do not operate a made-to-measure production line and we do not claim to. The garment is sourced, then professionally altered and finished to your measurements by a tailor. We say this plainly because the distinction matters, and because describing it otherwise would be misleading.

We do not name the mill or the cloth on this site, because we confirm the cloth with you individually before anything is altered. Any cloth we name to you in that conversation is a cloth we have actually sourced.

3. Price and GST

The Founding Fit dress shirt is AUD $329, inclusive of GST. The GST component is $29.91 and the price excluding GST is $299.09.

The price includes delivery within Australia, any remake made under the fit guarantee, and return postage within Australia. We do not currently ship outside Australia.

You may request a tax invoice for any order, and we will issue one within 28 days of the request. Prices may change, but never for an order already paid for.

4. Your measurements

We save a copy of your profile when you start checkout. Those numbers are frozen to that order, so a later edit to your profile does not change a shirt already in progress.

You are responsible for the measurements you enter. We check every profile by hand before alteration, and if a number looks inconsistent with the rest of your proportions we will come back to you before we start. That check is a safeguard, not a guarantee that we will catch every error.

5. How an order is formed

  1. You pay through Stripe. This is your offer to buy.
  2. We review your profile and contact you to confirm the cloth and base shirt fit at the collar and shoulder.
  3. Once we confirm the cloth with you, the order is accepted and alteration work begins.

If we cannot fill the order — the cloth is unavailable, the profile cannot be resolved, or we simply cannot do it well — we will tell you and refund you in full. We will not substitute a materially different cloth without asking you first.

6. Timeframes

We will give you an expected timeframe when we confirm your cloth. We deliberately do not publish a fixed turnaround before that conversation, because it depends on the cloth and on the work your profile requires. If we fall behind the timeframe we gave you, we will tell you rather than let the date pass quietly.

7. The fit guarantee

If the shirt does not fit, tell us where. We remake it once at no cost to you, including postage both ways within Australia. If the remake also does not fit, we refund you in full.

The full detail is on the returns and remakes page, which forms part of these terms.

8. Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms limits those rights. Where anything here conflicts with the Australian Consumer Law, the law applies.

9. Payment

Payment is processed by Stripe. We never see or store your card number — Stripe handles the card details directly. Your order is recorded against your account with us; your payment details are not.

10. Your account

You are responsible for keeping your password to yourself. Tell us promptly if you think someone else has access to your account. We may suspend an account we reasonably believe is being used fraudulently.

11. Liability

Other than the rights described in section 8 and any other rights you have that cannot lawfully be excluded, our liability for any single order is limited to the amount you paid for it. We are not liable for indirect or consequential loss.

12. Changes to these terms

We may update these terms. The version that applies to your order is the version published when you paid, and we keep a dated copy of each version. Changes are never applied retrospectively to an order already placed.

13. Governing law

These terms are governed by the law of Western Australia, and the courts of Western Australia have jurisdiction.
